LANDLORD-TENANT DISPUTES
At HZ Law we advocate for the rights of landlords and property owners. We bring an experienced depth of knowledge of rent regulatory laws, such as the Rent Stabilization Law and Code, Rent Control and landlord-tenant disputes. A landlord-tenant dispute can occur regardless of a detailed agreement or lease. Many times, eviction notices such as notices to cure or notices of default, notices to quit, notice of termination and nonpayment, and holdover petitions are necessary to enforce the rights of an owner or landlord.
Rent Control and Rent Stabilization laws are a complicated maze of statutes favoring the tenant and present obstacles for owners or managing agents. Luxury decontrol is a hot-button issue in New York, as it is a legislatively created mechanism that removes apartments from the protections of the Rent Stabilization law. Essentially, they become part of the free market. Landlords benefit from this because they no longer have to determine rent within a legal framework. Rent can be increased on an annual basis and there is a greater freedom of choice of tenants for the landlord. Our firm has helped owners maximize profits through its pioneering work in this area.
The landlord-tenant dispute attorneys at HZ Law also have experience representing owners and landlords in commencing and prosecuting both residential and commercial non-payment proceedings and holdover proceedings on such grounds as owner occupancy, non-primary residence, illegal subletting and lease defaults. These also include issues such as rights of successions, illusory tenancy, properly exercised options and interpretation of additional rent provisions. No matter what real estate problem clients may encounter, our team of lawyers have the expertise to resolve them effectively.
